General notes

The following notices provide a simple overview of what happens to your personal data when you visit this website. Personal data is any data by which you can be personally identified. For detailed information on the subject of data protection, please refer to our privacy policy listed below this text.

Data collection on this website

Who is responsible for the data collection on this website?

Data processing on this website is carried out by the website operator. You can find the contact details of the website operator in the section "Information about the responsible party" in this data protection declaration.

How do we collect your data?

On the one hand, your data is collected by you providing it to us. This can be, for example, data that you enter in a contact form.

Other data is collected automatically or after your consent when you visit the website by our IT systems. This is mainly technical data (e.g. internet browser, operating system or time of page view). The collection of this data takes place automatically as soon as you enter this website.

What do we use your data for?

Some of the data is collected to ensure error-free provision of the website. Other data may be used to analyze your user behavior.

What rights do you have regarding your data?

You have the right at any time to receive information free of charge about the origin, recipient and purpose of your stored personal data. You also have a right to request the correction or deletion of this data. If you have given your consent to data processing, you can revoke this consent at any time for the future. You also have the right to request the restriction of the processing of your personal data under certain circumstances. Furthermore, you have the right to lodge a complaint with the competent supervisory authority.

You can contact us at any time with regard to this and other questions on the subject of data protection.

Third-party analytics and tools

When visiting this website, your surfing behavior can be statistically evaluated. This is done mainly with so-called analysis programs.

Detailed information about these analysis programs can be found in the following privacy policy.

2. hosting

We host the content of our website with the following provider:

Webflow

The provider is Webflow, Inc., 398 11th Street, 2nd Floor, San Francisco, CA 94103, USA (hereinafter Webflow). When you visit our website, Webflow collects various log files including your IP addresses.

Webflow is a tool for creating and hosting websites. Webflow stores cookies or other recognition technologies that are necessary for the display of the page, to provide certain website functions and to ensure security (necessary cookies).

For details, see Webflow's privacy policy: https://webflow.com/legal/eu-privacy-policy.

The use of Webflow is based on Art. 6 para. 1 lit. f DSGVO. We have a legitimate interest in the most reliable presentation of our website. If a corresponding consent has been requested, the processing is carried out exclusively on the basis of Art. 6 para. 1 lit. a DSGVO and § 25 para. 1 TTDSG, insofar as the consent includes the storage of cookies or access to information in the user's terminal device (e.g. device fingerprinting) as defined by the TTDSG. The consent can be revoked at any time.

Data transfer to the USA is based on the standard contractual clauses of the EU Commission. Details can be found here: https://webflow.com/legal/eu-privacy-policy.

Job processing

We have concluded a contract on order processing (AVV) for the use of the above-mentioned service. This is a contract required by data protection law, which ensures that this processes the personal data of our website visitors only according to our instructions and in compliance with the GDPR.

3. general notes and mandatory information

Data protection

The operators of these pages take the protection of your personal data very seriously. We treat your personal data confidentially and in accordance with the statutory data protection regulations and this privacy policy.

When you use this website, various personal data are collected. Personal data is data with which you can be personally identified. This privacy policy explains what data we collect and what we use it for. It also explains how and for what purpose this is done.

We would like to point out that data transmission on the Internet (e.g. when communicating by e-mail) can have security gaps. A complete protection of the data against access by third parties is not possible.

Note on the responsible body

The responsible party for data processing on this website is:

Kaiser Promotion AG
Achslenstrasse 15
9016 St. Gallen

Phone: +41 71 313 99 11
E-mail: info@kaiserpromo.ch

The controller is the natural or legal person who alone or jointly with others determines the purposes and means of the processing of personal data (e.g. names, e-mail addresses, etc.).

Storage duration

Unless a more specific storage period has been specified within this privacy policy, your personal data will remain with us until the purpose for data processing no longer applies. If you assert a legitimate request for deletion or revoke your consent to data processing, your data will be deleted unless we have other legally permissible reasons for storing your personal data (e.g. retention periods under tax or commercial law); in the latter case, the data will be deleted once these reasons no longer apply.

General information on the legal basis for data processing on this website

If you have consented to data processing, we process your personal data on the basis of Art. 6 (1) a DSGVO or Art. 9 (2) a DSGVO, if special categories of data are processed according to Art. 9 (1) DSGVO. In the case of explicit consent to the transfer of personal data to third countries, the data processing is also based on Art. 49 (1) a DSGVO. If you have consented to the storage of cookies or to the access to information in your terminal device (e.g. via device fingerprinting), the data processing is additionally carried out on the basis of Section 25 (1) TTDSG. The consent can be revoked at any time. If your data is required for the performance of a contract or for the implementation of pre-contractual measures, we process your data on the basis of Art. 6 para. 1 lit. b DSGVO. Furthermore, if your data is required for the fulfillment of a legal obligation, we process it on the basis of Art. 6 para. 1 lit. c DSGVO. Furthermore, the data processing may be carried out on the basis of our legitimate interest according to Art. 6 para. 1 lit. f DSGVO. Information about the relevant legal basis in each individual case is provided in the following paragraphs of this privacy policy.

Note on data transfer to the USA and other third countries

Among other things, we use tools from companies based in the USA or other third countries that are not secure under data protection law. If these tools are active, your personal data may be transferred to these third countries and processed there. We would like to point out that no level of data protection comparable to that in the EU can be guaranteed in these countries. For example, US companies are obliged to hand over personal data to security authorities without you as a data subject being able to take legal action against this. It can therefore not be ruled out that US authorities (e.g. intelligence services) process, evaluate and permanently store your data located on US servers for monitoring purposes. We have no influence on these processing activities.

Revocation of your consent to data processing

Many data processing operations are only possible with your express consent. You can revoke consent you have already given at any time. The legality of the data processing carried out until the revocation remains unaffected by the revocation.

Right to object to data collection in special cases and to direct marketing (Art. 21 DSGVO)

IF THE DATA PROCESSING IS CARRIED OUT ON THE BASIS OF ART. 6 ABS. 1 LIT. E OR F DSGVO, YOU HAVE THE RIGHT TO OBJECT TO THE PROCESSING OF YOUR PERSONAL DATA AT ANY TIME FOR REASONS ARISING FROM YOUR PARTICULAR SITUATION; THIS ALSO APPLIES TO PROFILING BASED ON THESE PROVISIONS. THE RESPECTIVE LEGAL BASIS ON WHICH PROCESSING IS BASED CAN BE FOUND IN THIS PRIVACY POLICY. IF YOU OBJECT, WE WILL NO LONGER PROCESS YOUR PERSONAL DATA UNLESS WE CAN DEMONSTRATE COMPELLING LEGITIMATE GROUNDS FOR THE PROCESSING WHICH OVERRIDE YOUR INTERESTS, RIGHTS AND FREEDOMS, OR THE PROCESSING SERVES THE PURPOSE OF ASSERTING, EXERCISING OR DEFENDING LEGAL CLAIMS (OBJECTION UNDER ARTICLE 21 (1) DSGVO).

IF YOUR PERSONAL DATA IS PROCESSED FOR THE PURPOSE OF DIRECT MARKETING, YOU HAVE THE RIGHT TO OBJECT AT ANY TIME TO THE PROCESSING OF PERSONAL DATA CONCERNING YOU FOR THE PURPOSE OF SUCH MARKETING; THIS ALSO APPLIES TO PROFILING INSOFAR AS IT IS CONNECTED WITH SUCH DIRECT MARKETING. IF YOU OBJECT, YOUR PERSONAL DATA WILL SUBSEQUENTLY NO LONGER BE USED FOR THE PURPOSE OF DIRECT MARKETING (OBJECTION PURSUANT TO ARTICLE 21 (2) DSGVO).

Right of appeal to the competent supervisory authority

In the event of breaches of the GDPR, data subjects shall have a right of appeal to a supervisory authority, in particular in the Member State of their habitual residence, their place of work or the place of the alleged breach. The right of appeal is without prejudice to other administrative or judicial remedies.

Right to data portability

You have the right to have data that we process automatically on the basis of your consent or in fulfillment of a contract handed over to you or to a third party in a common, machine-readable format. If you request the direct transfer of the data to another controller, this will only be done insofar as it is technically feasible.

Information, correction and deletion

Within the framework of the applicable legal provisions, you have the right at any time to free information about your stored personal data, its origin and recipient and the purpose of data processing and, if necessary, a right to correction or deletion of this data. For this purpose, as well as for further questions on the subject of personal data, you can contact us at any time.

Right to restriction of processing

You have the right to request the restriction of the processing of your personal data. For this purpose, you can contact us at any time. The right to restriction of processing exists in the following cases:

  • If you dispute the accuracy of your personal data stored by us, we usually need time to verify this. For the duration of the review, you have the right to request the restriction of the processing of your personal data.
  • If the processing of your personal data happened/is happening unlawfully, you may request the restriction of data processing instead of erasure.
  • If we no longer need your personal data, but you need it to exercise, defend or enforce legal claims, you have the right to request restriction of the processing of your personal data instead of deletion.
  • If you have lodged an objection pursuant to Art. 21 (1) DSGVO, a balancing of your and our interests must be carried out. As long as it has not yet been determined whose interests prevail, you have the right to request the restriction of the processing of your personal data.

If you have restricted the processing of your personal data, this data may - apart from being stored - only be processed with your consent or for the assertion, exercise or defense of legal claims or for the protection of the rights of another natural or legal person or for reasons of an important public interest of the European Union or a Member State.

SSL or TLS encryption

This site uses SSL or TLS encryption for security reasons and to protect the transmission of confidential content, such as orders or requests that you send to us as the site operator. You can recognize an encrypted connection by the fact that the address line of the browser changes from "http://" to "https://" and by the lock symbol in your browser line.

If SSL or TLS encryption is activated, the data you transmit to us cannot be read by third parties.

Objection to advertising e-mails

The use of contact data published within the framework of the imprint obligation to send advertising and information materials not expressly requested is hereby prohibited. The operators of the pages expressly reserve the right to take legal action in the event of the unsolicited sending of advertising information, such as spam e-mails.

4. data collection on this website

Cookies

Our Internet pages use so-called "cookies". Cookies are small data packets and do not cause any damage to your end device. They are stored either temporarily for the duration of a session (session cookies) or permanently (permanent cookies) on your end device. Session cookies are automatically deleted at the end of your visit. Permanent cookies remain stored on your end device until you delete them yourself or until they are automatically deleted by your web browser.

Cookies can originate from us (first-party cookies) or from third-party companies (so-called third-party cookies). Third-party cookies enable the integration of certain services of third-party companies within websites (e.g. cookies for processing payment services).

Cookies have various functions. Many cookies are technically necessary, as certain website functions would not work without them (e.g. the shopping cart function or the display of videos). Other cookies can be used to evaluate user behavior or for advertising purposes.

Cookies that are necessary to carry out the electronic communication process, to provide certain functions that you have requested (e.g. for the shopping cart function) or to optimize the website (e.g. cookies to measure the web audience) (necessary cookies) are stored on the basis of Art. 6 (1) lit. f DSGVO, unless another legal basis is specified. The website operator has a legitimate interest in storing necessary cookies for the technically error-free and optimized provision of its services. If consent to the storage of cookies and comparable recognition technologies has been requested, the processing is based exclusively on this consent (Art. 6 para. 1 lit. a DSGVO and § 25 para. 1 TTDSG); the consent can be revoked at any time.

You can set your browser so that you are informed about the setting of cookies and only allow cookies in individual cases, exclude the acceptance of cookies for certain cases or in general and activate the automatic deletion of cookies when closing the browser. When deactivating cookies, the functionality of this website may be limited.

Which cookies and services are used on this website can be found in this privacy policy.

Consent with Usercentrics

This website uses the consent technology of Usercentrics to obtain your consent to the storage of certain cookies on your terminal device or to the use of certain technologies and to document this in accordance with data protection law. The provider of this technology is Usercentrics GmbH, Sendlinger Straße 7, 80331 Munich, Germany, website: https://usercentrics.com/de/ (hereinafter "Usercentrics").

When you enter our website, the following personal data is transferred to Usercentrics:

  • Your consent(s) or revocation of your consent(s)
  • Your IP address
  • Information about your browser
  • Information about your terminal device
  • Time of your visit to the website

Furthermore, Usercentrics stores a cookie in your browser in order to be able to assign the consent given to you or its revocation. The data collected in this way is stored until you request us to delete it, delete the Usercentrics cookie yourself or the purpose for storing the data no longer applies. Mandatory legal storage obligations remain unaffected.

The Usercentrics banner on this website was configured with the help of eRecht24. You can recognize this by the fact that the eRecht24 logo appears in the banner. To display the eRecht24 logo in the banner, a connection to the eRecht24 image server is established. In the process, the IP address is also transmitted, but this is only stored in anonymized form in the server logs. The image server of eRecht24 is located in Germany with a German provider. The banner itself is provided exclusively by Usercentrics.

Usercentrics is used to obtain the legally required consent for the use of certain technologies. The legal basis for this is Art. 6 para. 1 lit. c DSGVO.

Job processing

We have concluded a contract on order processing (AVV) for the use of the above-mentioned service. This is a contract required by data protection law, which ensures that this processes the personal data of our website visitors only according to our instructions and in compliance with the GDPR.

5. analysis tools and advertising

Google Analytics

This website uses functions of the web analytics service Google Analytics. The provider is Google Ireland Limited ("Google"), Gordon House, Barrow Street, Dublin 4, Ireland.

Google Analytics enables the website operator to analyze the behavior of website visitors. In doing so, the website operator receives various usage data, such as page views, dwell time, operating systems used and the origin of the user. This data is summarized in a user ID and assigned to the respective end device of the website visitor.

Furthermore, Google Analytics allows us to record your mouse and scroll movements and clicks, among other things. Furthermore, Google Analytics uses various modeling approaches to supplement the collected data sets and uses machine learning technologies in the data analysis.

Google Analytics uses technologies that enable the recognition of the user for the purpose of analyzing user behavior (e.g. cookies or device fingerprinting). The information collected by Google about the use of this website is usually transferred to a Google server in the USA and stored there.

The use of this service is based on your consent according to Art. 6 para. 1 lit. a DSGVO and § 25 para. 1 TTDSG. The consent can be revoked at any time.

Data transfer to the USA is based on the standard contractual clauses of the EU Commission. Details can be found here: https://privacy.google.com/businesses/controllerterms/mccs/.

Browser plugin

You can prevent the collection and processing of your data by Google by downloading and installing the browser plugin available at the following link: https://tools.google.com/dlpage/gaoptout?hl=de.

For more information on how Google Analytics handles user data, please see Google's privacy policy: https://support.google.com/analytics/answer/6004245?hl=de.

Job processing

We have concluded an order processing agreement with Google and fully implement the strict requirements of the German data protection authorities when using Google Analytics.

6. plugins and tools

Google Maps

This site uses the map service Google Maps. The provider is Google Ireland Limited ("Google"), Gordon House, Barrow Street, Dublin 4, Ireland.

To use the functions of Google Maps, it is necessary to store your IP address. This information is usually transferred to a Google server in the USA and stored there. The provider of this site has no influence on this data transmission. If Google Maps is activated, Google may use Google Fonts for the purpose of uniform display of fonts. When calling up Google Maps, your browser loads the required web fonts into its browser cache in order to display texts and fonts correctly.

The use of Google Maps is in the interest of an appealing presentation of our online offers and an easy location of the places indicated by us on the website. This represents a legitimate interest within the meaning of Art. 6 para. 1 lit. f DSGVO. If a corresponding consent has been requested, the processing is carried out exclusively on the basis of Art. 6 para. 1 lit. a DSGVO and § 25 para. 1 TTDSG, insofar as the consent includes the storage of cookies or access to information in the user's terminal device (e.g. device fingerprinting) within the meaning of the TTDSG. The consent can be revoked at any time.

Data transfer to the USA is based on the standard contractual clauses of the EU Commission. Details can be found here: https://privacy.google.com/businesses/gdprcontrollerterms/ and https://privacy.google.com/businesses/gdprcontrollerterms/sccs/.

You can find more information on the handling of user data in Google's privacy policy: https://policies.google.com/privacy?hl=de.

7. eCommerce and payment providers

Processing of customer and contract data

We collect, process and use personal customer and contract data for the purpose of establishing, defining the content of and amending our contractual relationships. We collect, process and use personal data about the use of this website (usage data) only to the extent necessary to enable the user to use the service or to bill the user. The legal basis for this is Art. 6 para. 1 lit. b DSGVO.

The collected customer data will be deleted after completion of the order or termination of the business relationship and expiration of any existing legal retention periods. Legal retention periods remain unaffected.

We would like to point out that we fully comply with the Data Protection Act, which has been in force in Switzerland since September 1, 2024. A corresponding declaration regulating the handling of personal data within the project contracts, the cooperation agreements and our digital presence can be viewed by customers, partners and other interested parties on our homepage, www.kaiserpromo.ch.

Data transfer upon conclusion of a contract for services and digital content

We transmit personal data to third parties only if this is necessary for the processing of the contract, for example, to the credit institution entrusted with the processing of payments.

A further transmission of the data does not take place or only if you have expressly consented to the transmission. Your data will not be passed on to third parties without your express consent, for example for advertising purposes.

The basis for data processing is Art. 6 para. 1 lit. b DSGVO, which permits the processing of data for the fulfillment of a contract or pre-contractual measures.

8. cooperation with partners, customers, suppliers and employees

Data protection

We attach great importance to the protection and security of personal data. Such data is treated confidentially and is not passed on to third parties, except for processing on our behalf or where we are legally obliged to do so. In this privacy policy, we explain the processing of personal data (hereinafter also referred to as "data") in the execution of a project contract with clients or a collaboration agreement with coaches.

We process personal data from the client's or coach's area, which is transmitted or becomes known to us in this context, for all purposes of initiating, making an offer, concluding, implementing and processing the contractual relationship with the client and the coach, as well as in order to be able to assert or fulfill legal claims arising therefrom.

IT systems

This generally includes contact details of affected persons, their function at the customer and in the project (including access for IT systems, such as Office 365 user accounts), content and processes of the project, insofar as these are related to persons, correspondence and logs, and possibly other data provided by the customer or resulting from the circumstances of the project.

We assume that the customer collects and processes the relevant data of its employees and contact persons in a lawful manner and makes it available to us for the fulfillment of the contract.

Data retention

We retain such contract-related data until the contract has been fully executed; beyond that, to the extent and for as long as this is useful to comply with legal claims in this regard or to protect rights; and finally, as long as there is a legal obligation to retain it (e.g. with regard to business documents).

We analyze and evaluate projects and processes, including the data collected for them, in order to improve our services. If certain data is no longer required for the aforementioned purposes, it may be used in anonymized form to further develop offers and services.

We use contact data for customers and business partners in order to maintain the customer relationship or business contact, to inform them occasionally about offers and services, and to be able to respond to queries or inquiries in a relevant manner.

Newsletter

In particular, we are happy to provide business partners and interested parties with occasional newsletters or similar information about our offers and services, provided they do not object to this. Addressees can send a message to Kaiser Promotion AG and unsubscribe from the newsletter distribution list.

We process data using IT service providers on a contractual basis, such as hosting service providers and server providers, in Switzerland as well as across borders in the EU or EEA. These jurisdictions offer mutually recognized, equivalent data protection law (certified by the competent authorities on both sides through adequacy decisions). Our service providers process personal data exclusively on our behalf and in accordance with our specifications and purposes. We select our service providers according to high professional standards, including security and reliability.

Rights

Our company, which is based in Switzerland, is subject to Swiss data protection law. Customers and data subjects can assert all rights granted to them by the applicable law.

Should the EU General Data Protection Regulation (GDPR) also apply in individual cases (e.g. in connection with a service offer to EU/EEA residents), the following also applies: We base the processing of your personal data, insofar as it is not already necessary for the initiation or fulfillment of a contract with them, on our legitimate interests, in particular to communicate with interested parties and business partners; to record and respond to their concerns and requests; and to continuously improve our services and offers (Art. 6 para. 1 lit.b or f GDPR); this also applies insofar as we have also been granted consent (there, lit.a), which - subject to other justification (lit. c) - can be revoked with effect for the future. Even if the GDPR applies, data subjects have the right to request information about their personal data processed by us; to request the correction of such data; to request the deletion of the data or the restriction of its processing for sufficient reason and subject to legal restrictions; or to object to the processing (Art. 15 to 18 and 21 GDPR).

Web

This website (including the web form and newsletter, together also referred to as our "digital presence") is operated by Kaiser Promotion AG (https://www.kaiserpromo.ch/). Kaiser Promotion AG is responsible for data processing in connection with the use of the digital presence. We attach great importance to the protection and security of personal data. Personal data is treated confidentially and is never passed on to third parties, except for processing on our behalf or where we are legally obliged to do so. In close cooperation with our hosting providers, we ensure that our databases are protected against unauthorized access, loss, misuse or manipulation using state-of-the-art technology. In this privacy policy, we explain how we process personal data when you use our digital presence.

Logfiles

In principle, the publicly accessible content and functions of our website can be used without disclosing personal data. However, the following data is recorded in log files when you access our website: IP address, date, time, browser request and general information transmitted about the operating system or browser. This usage data forms the basis for statistical, anonymous evaluations so that trends can be identified, which we can use to improve our services accordingly. They also serve to ensure the security of our systems, in particular to protect our website from misuse. This data is regularly deleted or overwritten by the live server within 7 days and the backup data is stored retroactively by the backup server for 1 year.

Newsletter and other communication

We use address data for sending newsletters and comparable communication about our offers and services to addresses if these have been provided to us personally or with a newsletter registration. We also use contact data from web form and e-mail inquiries for this purpose if we have received consent. Recipients of our newsletter can unsubscribe from the newsletter mailing list at any time; a link can be used for this purpose in every newsletter message. By providing your contact details, you consent to the processing of your personal data in accordance with this privacy policy.

Google Tag Manager

Furthermore, the Google Tag Manager is integrated, this is also a function offered by Google, which enables the higher-level control and operation of such analysis functions as Google Analytics, but - according to the provider Google - does not process any IP addresses or similar data relating to individual users. The provider Google itself provides more information on this: https://support.google.com/tagmanager/answer/9323295?hl=de.

Embedded web font

The Adobe Typekit font is integrated into the website to display the texts. This is a web-hosted font that is loaded directly from the provider's server when the font is displayed. As a result, the computer of a visitor to our website also interacts with the servers of the provider Adobe Inc. (responsible company: Adobe Systems Software Ireland Limited: 4-6 Riverwalk, City West Business Campus, Saggart, Dublin 24, Republic of Ireland) and the information about the visit to the website (with IP address and, if applicable, browser type, operating system and time) is also transmitted there. Such servers may also be located outside Switzerland, the EU and the EEA, namely in the USA. The provider Adobe itself provides more information on this: https://www.adobe.com/ch_de/privacy/eudatatransfers.html.

In order to ensure adequate protection of such information transmitted to Adobe, we have entered into the agreement offered by Adobe for these purposes, which contains the currently available protection guarantees.

Links to third-party services

We are also happy to present our information offerings on our social media channels (currently: Facebook, Xing, LinkedIn and YouTube). You will find direct links to these on our website. Videos that are available on our digital presence may also be stored on our social media channels (namely YouTube, recognizable by the red start button in the YouTube design). We would like to point out that by clicking on these links or calling up the videos, you switch to the services of the respective social media provider. These providers alone determine at their own discretion (and not on our behalf) which data is collected and processed there, for what purposes and in what way. These are currently the following:

For Facebook (Instagram): Meta Platforms Ireland Limited, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland

For Xing: New Work SE, Am Strandkai 1, 20457 Hamburg, Germany

For YouTube: Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland.

For LinkedIn: LinkedIn Ireland Unlimited Company, Wilton Place, Dublin 2, Ireland

In particular, data may be collected there and possibly linked to other data if you are logged in as a user of these services. Please refer to the privacy policies of these providers for more information. We cannot accept any responsibility for such data processing.

Transfer of personal data abroad

We process data using IT service providers on a contractual basis, such as hosting service providers and server providers, in Switzerland as well as across borders in the EU or EEA. These jurisdictions offer mutually recognized, equivalent data protection law (on both sides, the competent authorities of the other side have certified this). Our service providers process personal data exclusively on our behalf and in accordance with our instructions and purposes. (For cross-border data processing in connection with Google Analytics, see "Google Analytics")
